Question: I have a 17 yr old daughter who has a baby and just moved back with me. She was staying at a friends house for 3 months! She turns 18 in January she is mean to me calls me names and is mean to her brother who has autism! Is there anyway I can make her and her baby move before she turns 18?
Answer: This is for informational purposes only; you may want to contact an attorney for legal advice. Under Arizona Revised Statute 25-501 - Duties of Support; exemption: This statute states, in relevant part, "A. ...every person has the duty to provide all reasonable support for that person's natural and adopted minor, unemancipated children, regardless of the presence or residence of the child in this state... If a child reaches the age of majority while the child is attending high school or a certified high school equivalency program, support shall continue to be provided while the child is actually attending high school or the equivalency program but only until the child reaches nineteen years of age unless the court enters an order pursuant to section 25-320, subsection E [which relates to child support past the age of majority for severely mentally or physically disabled adults and isn't relevant here] In other words, you likely must let her stay until after her 18th birthday.
