Question: My daughter has filed for custody of her son of 1 year. The farther said he would give her full custody and sign the papers for that, what's the next step for my daughter and is he basically giving up his rights to the baby? Would he still have to pay child support and does she have to let him see the baby still?so e one please help.
Answer: Of course, the first step is to actually get the father to sign papers granting her full custody. You have not indicated whether your daughter is working with a lawyer who is drafting the custody agreement for her. Any such custody agreement would need to be approved by the court. If your daughter does not have a lawyer representing her, she should at least consult one to get advice about drafting the agreement. There are 3 programs in Arizona that you can use to get some inexpensive legal advice and guidance. One is the Modest Means Program. Both the Maricopa County Bar Association and the Pima County Bar Association have lawyer referral services that offer a 30 minute consult with an experienced attorney.
