Answer: The question here is what do you mean when you say your ex "gave his rights up." Did a court issue an order terminating his parental rights? Or do you mean he gave you full custody rights? They are very different things. If his parental rights were severed in a court action, he has only a limited time to appeal that decision before it becomes final. Because your question is complicated and depends on the paperwork that was filed and court orders issued, it would be best if you discussed the matter with an attorney. There are 3 programs in Arizona that you can use to get some inexpensive legal advice and guidance. One is the Modest Means Program. If you are financially qualified for the program, for a $75 fee, Modest Means will arrange a one hour consult with an experienced attorney.
