Child Support
questions & answers
Question: Original visitation & support orders were given in WA eight years ago. That order included $650 a month in childcare which is no longer needed since the child is 11. The custodial parent lived in CA at the time of order, but filed in WA. The non-custodial parent now resides in AZ. If the non-custodial parent was to modify the support order, what state would that be in …. in AZ? Or is jurisdiction still WA?
Answer:
There are many factors considered when determining what state will modify an existing order for support. You may want to contact an attorney to find out how the laws apply to your specific situation. In addition, you may want to review the Arizona statutes iscussing the Uniform Interstate Family Support Act, which can be found in the Arizona Revised Statutes, Title 25, Chapter 9 (beginning with A.R.S. § 25-1201).
