Question: My ex has sole custody of my 17 year old daughter. In November 2010, my daughter spent 2 weeks in residential treatment for cutting. When my daughter was discharged from treatment, it was recommended she participate in more treatment, my ex is not following thru with this. My daughter sounds they way she did whenshe was cutting, I am worried w/o treatment she will hurt herself. Can I file for emergency custody? Called CPS but they are not sure if they will bebable to respond timely. Can I file the one where my ex is not served? Not sure if the situation meets the criteria for that?
Answer: The forms to a file for temporary emergency modification of custody without advanced notification to the other party can be found on the Superior Court Website. To locate the closest Superior Court use the Courts Locator. The Maricopa County Superior Court Website lists requirements for obtaining emergency modification of custody. Please refer to their website for these requirements and for forms needed to file for emergency modification of custody and/or parenting time.
