Child Custody

questions & answers

Question: My daughter had a child out of wedlock. Her boyfriend is threatening to fight for custody. What are his rights and chances of acquiring custody? He is on the birth certificate.

Answer: If you live in either Maricopa or Pima Counties, you can go to their self service center to file for custody. https://www.superiorcourt.maricopa.gov/SuperiorCourt/Self-ServiceCenter/. If outside of Maricopa or Pima County, you would need to go to the Superior Court in your county to see if they have specific forms to be filed. If they do not , you can use the forms from Maricopa County. You may also want to contact an attorney for advice on how to obtain custody of the child.
