Question: My wife and I are divorced and share custody of my 3 year old daughter. Our divorce we must agree on school or we have to go back to court. Does the state of Arizona consider preschool or is it when child starts kindergarten?

Answer: The state of Arizona does not have a definition of when school starts for the purposes of decision making in a situation with joint legal custody and equal decision making ability in regard to the school of the child. Because preschool may be considered education, you may have to agree on a location for preschool. In the event of a disagreement, seeking the assistance of a mediator may be helpful. A mediator is a 3rd party that helps to facilitate conversations and agreements between individuals when disputes arise.
