Child Custody
questions & answers
Question: Can my wife move with my children out of state? I have a career in Arizona. She has a recently acquired minimum wage job. We're divorcing and she wants to leave AZ.
Answer:
If both parents are entitled to joint legal decision-making or unsupervised parenting time and both parents live in Arizona, the parent desiring to move with the child must give 60 days' written notice to the other parent before the child may be moved to a residence more than 100 miles from the previous residence or from the state. The non-moving parent may petition the court for a hearing to stop the move of the child within 30 days after notice is made.(http://www.azcourts.gov/Portals/34/LDMBookletRED.pdf). You may wish to speak with an attorney for further instructions.
