Question: If my wife takes our kids from our home to live in California and won't let me see or speak to the kids do I have to goto California to pursue custody or can I file in az since we have lived here for 10 years
Answer:
There are several factors that must be considered when you are attempting to file a case in court one of which is the court that has jurisdiction. In Arizona family law cases involving children are filed in the same place the pre-existing orders for the child were filed. If no orders have been filed, then it would be filed in the county where the child resides.
