Question: Currently pregnant- father wanted nothing but an abortion. Time has passed and he wants a DNA test. If the child is his can I petition to terminate his rights? I have proof of him wanting an abortion. I do not want child support or nothing- solely for him to not be involved since that is what he decided since the beginning.

Answer: If a man files a paternity action in family court and the test determines he is the father, he will be ordered to pay child support.  However, if he wants that DNA test, the burden is on him to file a paternity action in Superior Court, pay the filing fees, and have the papers served on you in accordance with the law.  You would then have the right to respond. You have no obligation to agree to a DNA test outside of a paternity action.
