Question: I live with my boyfriend and the father (who is 24) of my 3 month old son. His father, who he has no relationship with due to past history, is demanding visitation and is harassing and threatening us. What are our rights?

Answer: The grandfather has the right under A.R.S. Section 25-409 to file a petition in family court and ask for visitation rights with the grandchild.  The law would allow you as the parents to respond to the petition and state your reasons for refusing visitation.  There may be a hearing scheduled with a judge making a decision based on the evidence presented.  However, if he has not taken those legal steps and obtained a court order for visitation, you, as parents, have the right to decide who your child sees.
