Question: Our daughter is planning to enlist in the Navy and need to know what we as the grandparents need to do to get custody of our 9 month old grandson while she is gone.My daughter is in agreement of this but need to know what we need to do legally.She will be gone at least five years. Also what is the time frame this will take to get legal custody?
Answer:
Arizona revised statutes A.R.S. § 8-871 and § 8-872 give the laws on whom and how a person can obtain guardianship in the state of Arizona. You can find out more information on guardianship, the process for guardianship and the necessary forms through your local Superior Court. For Maricopa County, you can view the documents on the court's website. If you are outside Maricopa, please click here to find the correct county.
If in Maricopa county, an individual seeking temporary guardianship of a period lasting more than six(6) months, a request for “permanent guardianship” shall be applied for. The individual can go to the Maricopa county website section that instructs how an individual can apply for guardianship.
Guardianship matters can be very complex; thus, a person may want to contact an attorney to discuss how the laws apply to a certian situation.
