Question: My son is almost 9 years old and has never seen or met his biological father. He does not even know about him. My fiance has been his dad since he was 2. The bio dad has never attempted to see him or take responcibility and now that he is out of prison he all of a sudden wants to stake claim. Can he do this?

Answer:

When parents cannot agree about child custody, custody becomes an issue for the Court to decide. Only a Superior Court can decide custody and parenting time. A parent can seek "sole custody" of their child, whereby the court orders that one parent is responsible for making the major decisions regarding a child's care or welfare.  See A.R.S. 25-403.  For more specific advice on your situation you may want to consult an attorney.
