Question: I have sole custody of my 12 yr old daughter and my current husband has been laid off and we have no current income. Husband's company contacted him about a possible job opening in a different state. I understand that I must send a certified notification to ex-spouse but am I required also to notify the courts and/or complete a visitation modication?
Answer: You may want to review ARS 25-408, which is Arizona's relocation statute. It explains the different ways that a person ca accomplish notice to the other side. Technically, you do not have to inform the court if you choose to notify Father directly by certified mail rather than file a formal motion. But there are pros and cons to both strategies, and should be discussed with a licensed family law attorney who has experience with custody and relocation matters.
