Question: If I never got cited or arrested for misd. theft, and now after four months the state picked it up, can the plaintiff drop charges.
Answer: The prosecutor can drop the charges at any time for a variety of reasons. Under ARS 13-107, the statute of limitations to file a charge against someone for a misdemeanor offense is 1 year from the date of the violation.
