Protection Orders

questions & answers

Question: I was involved with a woman and broke things off, she went and filed an order of protection last year, I wanted to fight it judge said if I did I would lose my gun rights, so it was modified so I could keep my gun and rights. That expired last year in July 2013. Today I was served again with another order of protection, Again all reasons listed are False! And now I have to turn over my gun. How can one fight the order of protection without losing gun, gun rights? How can one fight these false allegations? I don't want anything to do with this woman, She is telling lies to court to get order!

Answer: To request a hearing on an Order of Protection, the Defendant must go to one of the Protective Order Centers to complete a Request for Hearing form. A hearing date will be set and the plaintiff will be notified of the hearing. The Defendant has the right to request one hearing within one (1) year from the date he/she is served with the protective order. The defendant must file a written request for a hearing in the same Court that issued the Order of Protection or Injunction against Harassment. If the order is modified, the modified order has to be re-served and is effective for one year from the date of service of the original order. If the defendant does not accept the order while in the court, the judicial officer may detain the defendant until a law enforcement officer is summoned to serve the defendant the order. If you live outside Maricopa County, you may download and complete the Notice of Hearing form that is located on the Court's website at: http://www.superiorcourt.maricopa.gov/SuperiorCourt/Self-ServiceCenter/Forms/DomesticViolence/dv_group_2.asp.
