Question: I was charged with a crime in 2007 and the district attorney never decided to file charges in time but this charge is on my record is preventing me from job oppourtunities what can I do
Answer: There are Federal protections for applicants with a criminal record. The Fair Credit Reporting Act (FCRA) addresses the issue of accuracy. Criminal records may include inaccurate information. The FCRA imposes obligations on employers who request criminal background checks and on the firms that provide them. Employers must do all of the following: (1) Get the applicants written consent ahead of time. (2)Tell the applicant if the employer intends to disqualify him or her based on the contents of the report. (3) The employer must also give the applicant a copy of the report (4) Notify the applicant after the employer makes a final decision not to hire him or her based on the information in the report.
