Question: Is it legal for my employer to offer health benefits to same-sex commited partners but not to opposite-sex commited partners?
Answer:
The Civil Rights Act of 1964 states "Nothing contained in this article shall be interpreted to require that the less qualified be preferred over the better qualified simply because of race, color, religion, sex, age, disability or national origin."(41-1463) It does not cover sexual orientation.
