Unemployment Compensation

questions & answers

Question: I was laid off, but my boss from that employer is claiming I quit. I filed an appeal and soon i'll have my hearing. The proof I have to him laying me off is via text message, and the keywords he said are "due to the corona virus customer are cancelling, clearly not enough work to keep you." Do you think that evidence will be enough to win in court?

Answer: Unfortunately, it is impossible to predict what the result of any administrative or judicial hearing will be. Although it is always helpful to be able to present as much evidence as possible, the purpose of presenting evidence is to support one’s own testimony. So the best way to prepare for a hearing is to think about what one’s best arguments are then to consider how the evidence can be used to strengthen those arguments.
