Question: My ex wife was in a car accident in my vehicle and she was at fault. the car had no auto insurance during the accident, now the other parties insurance is suing us. I lend her my car while we where going through a divorce so she could drive our son around. her and i agreed verbal she would cover the insurance (she only did it for a few months apparently and let it laps), i was not aware she did not pay the insurance and was driving with a suspended licence. She is saying i am responsible for the fees is this true?

Answer: Who is the recorded owner of the vehicle on file with the Department of Motor Vehicles.  If it is you, it is your responsibility to keep the vehicle insured with at least the minimum liability limits.  If you were still married at the time of the accident, you may have joint liability.  You should sit down and talk to an attorney about your options.  There are three programs in Arizona that you can use to get some inexpensive legal advice and guidance.  One is the Modest Means Program.  You will need to apply for the program and meet the financial need qualifications.  Once qualified, Modest Means will send you a list of attorneys to choose from.  Then, for a $75 fee, you will receive a one hour consultation with the attorney.  If you need additional help and the attorney agrees to take your case, the fee charged will not be more than $75 per hour.  The telephone number is (866)  637-5341.  Both Maricopa and Pima County Bar Associations have Lawer Referral programs that offer a 30 minute consult with an attorney.  Maricopa County's Lawyer referral Service offers a 30 minute consult with an experienced attorney for a fee of $40.  The telephone number is: (602) 257-4434.  Pima County Lawyer Referral Service offers a 30 minute consult with an experienced attorney for a fee of $35.  The telephone number is (520) 623-4625.
