Question: I gave my landlord $2000 security deposit and an aditional $750 non-refundable pet deposit. does the landlord have to use up the 750 towards repair and clean-up befoure witholding the 2000
Answer:
The lease agreement is a contract that states the rights and obligations of the tenant and landlord, according to A.R.S. 33-1314.A. The lease agreement may also state the order by which the monies are used.
The landlord shall state the purpose of all non-refundable fees and deposits under A.R.S. 33-1321.B. Upon demand by the tenant, the landlord shall provide an “itemized list” of all deductions from the deposits together with the amount due and payable to the tenant, as explained in A.R.S. 33-1321.D.
