Question: Landlord decease, will that terminate my lease contract & i will be evicted from the property?do i have any rights
Answer: This is a complex issue. A lease agreement or lease contract between the tenant and the landlord is legal contract; most often, it is a written agreement. Generally, depending on the type of lease, if it is more than just a month-to-month lease, it will terminate upon the date specified in the lease agreement. Otherwise, a month-to-month lease is an at will lease and can be terminated whenever one party is no longer willing or able to continue with the contract by giving ten day notice, see generally ”ARS 33-341 . If rent is paid on time and the tenant has continued to do what is required by the lease, it cannot be terminated except upon the end date specified in the lease. After this day, the new owner of the property may renew or terminate the lease. However, most leases contain additional provisions and it is in the tenant’s best interest to read over the lease to discover these provisions.
