Question: how long can i stay in a rental home if i do not pay rent. and also how long before i will be evicted if i do not pay rent.
Answer: Assuming the landlord acts promtly and an eviction action can take between 13-16 days. If rent is not paid when due a landlord must provide five days written notice that the rental agreement will terminate unless paid. If still unpaid the landlord may file a 'special detainer" (eviction) lawsuit which must be scheduled no sooner than three days after filing or later than six days. If found "guilty" at the hearing the Court shall issue a "writ of restitution" no sooner than five calendar days after the date of judgement.
