questions & answers
Question: My grandfather owns a Rv park and wants to get rid of a Rv that the owner died. Can he get sale legally. Plz help.
Answer: Your grandfather needs to contact the lien holder on the title if there is one and/or the heirs of the person who died if he can locate them. They will likely agree to remove the RV or agree to the sale, but they would be entitled to the money from the sale. Arizona law (ARS ยง 33-2144) says that an RV park owner can send a notice to the owner (here the heirs) or lien holder telling them they owe back space rent if an RV is abandoned. After that notice is sent, the heirs or the lien holder are responsible for all costs. Your grandfather should sue the heirs or the lien holder for the back charges in small claims court, get a judgment for monies owed and then get a court order to the sheriff to sell the RV.
