Question: My father died and his wife of 6year is still living in his house but she is not my mother. Can i eviction his wife since she does not wanna pay any bills dealing my fathers house i have been paying the house taxes and insurance. Because she doesnt want to pay anything . But refuse i to keep paying bills that she has to pay I dont want my dads house to foreclosure that is y im paying these bills. Need ur advice. Thanks in advance.
Answer: Failure to pay local property taxes can result in a tax lien on the property, but usually, not immediate foreclosure. Failure to pay homeowner’s insurance does not normally lead to foreclosure, unless specified by the lender as grounds for this. If a homeowner dies “intestate” (without a will), and the property is held in his name only, the courts must follow laws of intestate succession. In Arizona, the Probate court should have determined who now owns the property and if the property was in fact held in his name only (decedent’s “separate property” pursuant to Arizona's “community property" rules), the spouse and children presumably were ordered to share the property. As co-owner, the spouse cannot be "evicted" as a tenant. However, many factual and legal issues appear to exist re ownership responsibilities.
