Question: I rent a room in my house with only a verbal contract, contract was month by month and only agreement was to pay rent within the first week of the month and to take care of her dogs. In approximate 5 months rent was never paid on time and dogs destroyed other individual property, owner refused responsibility for damage, I asked her to leave the house with a 3 weeks notice and she refused saying she will be out after Christmas. I have texts from her saying she will be late with the rent and witnesses about the damages her dogs caused. Please advise how should I proceed.
Answer:
According to ARS 33-1375, “The landlord or the tenant may terminate a month-to-month tenancy by a written notice given to the other at least thirty days prior to the periodic rental date specified in the notice.” The “periodic rental date” is the beginning of the next rental term. An attorney who is experienced in dealing with housing issues would be able to aid you in finding the correct legal process due to the unique nature of your situation.
