Question: I am a section8 tenant and recently found out that I am not responsible for any portion of the rent because The City of Phoenix Section8 pays the entire rent amount and has done so since I began living in the unit. I have paid $50/mth on top of what they get from section8. I was told thats what Im suppose to pay and have done so since I moved in. Now that I have this information, I would like a refund of the payments made that were made. What is the best way to formally request this money?
Answer: Under HUD 52641: 5. Family Payment to Owner b. Each month, the PHA will make a housing assistance payment to the owner on behalf of the family in accordance with the HAP contract. The amount of the monthly housing assistance payment will be determined by the PHA in accordance with HUD requirements for a tenancy under the Section 8 voucher program. e. The owner may not charge or accept, from the family or from any other source, any payment for rent of the unit in addition to the rent to owner. Rent to owner includes all housing services, maintenance, utilities and appliances to be provided and paid by the owner in accordance with the lease. f. The owner must immediately return any excess rent payment to the tenant. This is for informational purposes only, you may want to contact an attorney for advice.
