Question: I agreed to lease my condo to a women and her two small children for $600. a month with a $400. deposit. She gave me $310. to hold the condo. I mailed her the lease for her to sign and never received it back. She has been in the condo for 2 months now and has only paid $300. towards the rent and deposit. I place an eviction notice on her door as she will not answer her phone. She responded see you in court. What can I do?
Answer: First you must deliver a "5 day notice" specifying the amount of rent owed and telling her if she does not pay within 5 days of the letter you are terminating the rental agreement. This must be personally delivered or sent by certified/registered mail. Placing it on the door is insufficient. If she does not pay you then file an eviction action in Justice of the Peace Court. You can obtain the form necessary on the website of the Marcicopa County Justice of the Peace Courts.
