Landlord and Tenant Rights and Responsibilities
questions & answers
Question: Can a new lease be done for a year and a another lease for the same year but with a different amount and can the landlord ask for your social security card after giving all prove when I moved in
Answer: As a general rule, once a landlord and a tenant have entered into a rental agreement, that agreement becomes an enforceable contract between the parties that can only be altered or terminated (1) if both parties agree in writing or (2) if one of the parties violates the agreement or other applicable law. If a landlord and a tenant sign a lease, that lease becomes binding on both. Unless both parties later agree in writing to terminate that lease, it ordinarily remains in effect. It is unclear from your question if you have already signed a second lease, but either way what matters the most in these situations is whether or not the tenant has agreed to each arrangement both freely (without coercion) and knowingly (fully informed of the content and consequences of the agreement). As for the social security number, a landlord may ask for a social security number (although not the card itself) during the application process. But once a lease has been signed and the tenant has moved in, the tenant generally is under no obligation to provide any additional personal information to the landlord.
