Answer: Under the Arizona Residential Landlord and Tenant Act (A.R.S. Title 33 Chapter 10), a tenant is not permitted to withhold rent, even if the landlord has failed to make required repairs (A.R.S. 33-1368(B)). Instead, the tenant may deliver to the landlord written notice describing the problem(s) that need to be fixed and stating the tenant’s intention to terminate the rental agreement if the repairs are not made within a reasonable period of time: 10 days if the problems are serious and 5 days if the problems materially affect health and safety (A.R.S. 33-1361). Even when a tenant has provided the landlord with a security deposit in an amount equal to or greater than the final month’s rent, the tenant must continue to pay that rent separately so long as they live in the dwelling.
