Question: My ceiling has fallen down and there is extreme mold im home. My rent is due. Should i have to pay rent if not repaired?
Answer: Under Arizona law, a tenant may not withhold rent in order to force their landlord to make repairs, even if those repairs are necessary (A.R.S. 33-1368(B)). If a tenant fails to pay rent, their landlord will have a legal basis on which to seek the tenant’s eviction. So long as a tenant continues to live in a dwelling, the tenant must pay rent in full and on time.
