Question: When there is a fire in your apartment what responsibilities does the landlord have as far accommodating me and making sure the apartment is free of any hazardous materials
Answer: The landlord has a duty under the Arizona Landlord/Tenant Act to maintain the premises in a fit and habitable condition. (Arizona revised Statutes, Section 33-1324). That would include promptly repairing fire damage and removing any hazardous conditions. If the dwelling was seriously damaged or destroyed by fire, the tenant has the right to vacate the apartment and notify the landlord in writing within 14 days of his intention to terminate the lease. (A.R.S. section 22-1366). If the apartment is unlivable and the tenant terminates the lease, the landlord must return his security deposit. If only part of the apartment or dwelling is damaged and unlivable, the landlord will be obligated to reduce the rent to reflect the changed living conditions.
