Question: If I'm on SS/Disability and don't get paid until the 3rd of every month can my apartment manager charge me a late fee for paying rent on the third not the first of the month? I had been told by the previous manager that it's illegal for him to do so. Now the new/current manager says that he (previous Mgr) was wrong, misinformed. I need to get a straight answer. Not the he said, she said that happening. Thank you for your help
Answer: Under Arizona law, rent is due whenever the rental agreement between the landlord and the tenant says rent is due. If the rental agreement does not specify when rent is due, then rent is due on the 1st of the month (A.R.S. 33-1314(C)). A tenant who wishes to have rent be due on a date other than the 1st of the month, regardless of the reason, must negotiate that with the landlord.
