Question: I'm buying the house that I live in. A friend needed some help and I rented my back yard to her so that she and her family had a place to stay. She stopped paying rent about a year back and things are going down hill bad. What paper work do I need to file to evict, she live in a motorhome.
Answer: A tenant who has failed to pay rent may be given a 5-day pay or quit notice then (after 5 days have passed since the day after the tenant was given the notice) served with a summons and eviction complaint (A.R.S. 33-1368(A)). A landlord who does not wish to evict a month-to-month tenant for nonpayment of rent but still wishes to force the tenant out may give the tenant a 30-day notice of termination of the tenancy (to go into effect at the end of the following month) (A.R.S. 33-1375). If the tenant remains even after the tenancy has ended, then the landlord will have no choice but to pursue an eviction.
