Question: My mother has a home in Sahuarita but at this time is living with my sister for medical reasons my brother her son lives in her home and Sahuarita he does not pay any of the household bills my mother is paying for everything my mother and myself are both on the deed of her home . for financial reasons my mother can no longer afford to keep her house it needs to be sold how do we get my brother to move out what are our legal options????
Answer: You are on the deed with your mother as co-owners of the property. If you are unable to convince your brother to move out of the house, your best first step is to write him a letter informing him that you and your mother intend to sell the house and he has 30 days to find another residence. Keep a copy of the letter and send it to him by certified mail, return receipt requested. You can also hand-deliver the letter so long as you have proof of delivery (a witness). If he does not comply, you and your mother will need to file a forcible detainer action against your brother and serve him with copies of the summons and complaint.
