Question: I heard a rumor that the trailer park management wants to evict all tenants with mobile homes older than 45 years, regardless of their condition, destroy the trailers and replace with new ones. Is that legal?

Answer: Under the Arizona Mobile Home Parks Residential Landlord and Tenant Act, changes in use and redevelopments of mobile home parks are permitted in certain circumstances so long as their landlords follow the rules, which include providing their tenants with advance written notice as well as information about Arizona’s mobile home relocation fund (A.R.S. 33-1476.01-.05). If and when your mobile home park’s landlord confirms its rumored plans in writing, you may wish to ask a lawyer to review those plans with you.
