Landlord and Tenant Rights and Responsibilities
questions & answers
Question: Can public housing ask for an increase of security deposit after 3yrs
Answer: Unless a tenant is transferred from one unit to another, in which case the landlord may refund the original security deposit and charge a new (higher) security deposit, the amount of the original security deposit should not change, even if the monthly rent amount does. The HUD Occupancy Handbook discusses security deposits here: https://www.hud.gov/sites/documents/DOC_35650.PDF. It might be wise to seek clarification from your local public housing authority. A list of Arizona public housing authorities and their contact information is available here: https://www.hud.gov/sites/dfiles/PIH/documents/PHA_Contact_Report_AZ.pdf.
