Question: I prepaid for a 1 year spot at an RV park. I am about 5 months into the agreement. I have not asked the landlord yet; but, do I have any recourse to get a refund? Mitigating circumstances, Covid-19 closed many of the amenities that caused me to go here, and I am moderately concerned about getting laid off because of Covid-19.

Answer: The applicable laws to RV park rentals of more than 180 days in Arizona are found at Arizona Revised Statutes 33-2101 - 2151. Nothing in the statutes requires the landlord to do anything but (A.R.S. 33-2123): 1. Make all repairs and do whatever is necessary to put and keep the premises in a fit and habitable condition. 2. Comply with all applicable provisions of city, county and state codes materially affecting health and safety. I am not aware of any law that would allow you to terminate the agreement or receive a refund based on the lack of amenities caused by the pandemic. Please do note that the landlord may have a claim for possession of your RV based on unpaid rent (A.R.S. 33-2145). Be careful of this provision. Your best bet may be to try to negotiate something with the landlord. I wish you the best.
