Foreclosure
questions & answers
Question: If a writ of eviction is issued after a foreclosure, must the new owner store the evicted person's goods, or are they put out on the street?
Answer: The landlord cannot simply put your personal items out on the street. Most likely when the Sheriff shows up to serve the writ of eviction they will not actually "throw you out" but will arrange a date shortly thereafter for you to move out. If necessary they will arrange for your items to be removed and stored and if necessary sold at auction. You will be able to get your things back but it will require paying for the costs incurred by the Sheriff or private entity in removing, moving and storing your personal items. It would obviously be best, once a writ of eviction has issued, to arrange for your own move.
