Question: Does the Landlord have the right to do and inspection without the tenant being present. In this case they refuse to set an appointment. They intent to just walkin while the tenant is away working.

The Arizona Residential Landlord and Tenant Act governs the lawful and unlawful behavior of landlords and tenants and can be found under §§ 33-1301- 1381 of the Arizona Revised Statutes. A.R.S. § 33-1311 requires that Landlords deal with Tenants in good faith. A.R.S. § 33-1314 allows landlords and tenants the ability to create a rental agreement in any way that is not prohibited by law. A.R.S. § 33-1321(C) provides that a landlord will provide written notification to the tenant that the tenant may be present at the move-out inspection. Further, upon request by the tenant, the landlord shall notify the tenant when the landlord's move-out inspection will occur. This statute also provides that if the landlord has reasonable cause to fear violence or intimidation on the part of the tenant, the landlord has no obligation to conduct a joint move-out inspection with the tenant.
