Question: there is no due date on my lease agreement, can the landlord evict me if i dont pay rent or not pay rent that month?
Answer: The Arizona Residential Landlord and Tenant Act says the following: “Rent shall be payable without demand or notice at the time and place agreed upon by the parties. Periodic rent is payable at the beginning of any term of one month or less, and thereafter, unless otherwise agreed, in equal monthly installments at the beginning of each month. Unless otherwise agreed, rent shall be uniformly apportionable from day to day” (A.R.S. 33-1314(C)). In other words, unless the landlord and the tenant agree otherwise, the tenant must pay rent on the first of the month – and a tenant who fails to pay rent in full and on time may be given a 5-day notice then taken to court by the landlord.
