Landlord and Tenant Rights and Responsibilities

questions & answers

Question: I am going to be leasing my house out and I am in the process of preparing a lease agreement. Can I require the tenant to carry renters insurance in the terms of the lease agreement? If so, what are the restrictions on what I can require?

Answer: A lease is a contract between the landlord and the tenant. Generally it can include any provision agreed to by the parties. ARS 33-1315 does list a number of "prohibited provisions". None of these deal with renters insurance.
