Question: I rent a mobile home that has a large front and back yard. My landlord is always on the property and coming over unannounced. I understand I rent from him but how much privacy am I entitled to? The landlord also has a storage shed that sits behind the mobile home. We don't use. The neighbor next door comes over whenever he pleases and uses the storage shed. He says the landlord lets him use it. I feel like I have no privacy whatsoever!
Answer: According to Arizona Revised Statute 33-1343... the landlord is allowed enter residence to 1. inspect, 2. repairs, 3. decorations, 4. alterations, 5. improvements, 6. necessary or agreed upon services, 7. show unit to prospective/actual purchasers, mortgagees, tenants, workmen or contractors. If you, as tenant, request service or maintenance...that request constitutes consent. The landlord can enter without consent if there is an emergency. However, the landlord is not to abuse the right to access or harass the tenant. Landlord needs to give at least 2 days notice of the intent to enter. Landlord can only enter at a reasonable time. Landlord has no other right to access unless permitted by court or tenant abandoned property. I would recommend you consult a lawyer in reference the storage shed and also have a conversation with the landlord in reference allowing other tenants to come on your property.
