Question: How many people can legally occupy a 400 sq. ft. studio apt. Only one person is on the lease.

Answer: A landlord may limit in the lease who (and how many people) may reside in a particular unit. A landlord may also limit occupants to those listed in the lease if so stated in the lease. Other than that, I am not aware of any presumptive limit by statute or otherwise.
