Landlord and Tenant Rights and Responsibilities
questions & answers
Question: My lease ended on 12/31/14. I haven't signed a new lease and it's already May 2015. Am I considered month to month? Can the property manager still have a judgement put against me for non payment of rent?
Answer: Yes you are a month to month tenant. If you haven't paid your rent, the landlord can file an eviction action to have you removed for nonpayment. You could dispute it in court if you have some valid reason. If you lose, the landlord will be awarded a judgment against you for the unpaid rent and other damages the court awards.
