Landlord and Tenant Rights and Responsibilities

questions & answers

Question: Can a landlord or management company change their property rules to No Smoking inside your dwelling or outside after 30 years??? This has been my home for 8 years and I think this is a personal choice and I feel that I am being discriminated against. Thank you in advance for your answer, Andy

Answer: According to Arizona Smoke Free Living (http://azsmokefreeliving.org/residents/tenants-rights/) there is no "right to smoke" under the US laws.

Smoke-Free Arizona Act (A.R.S. § 36-601.01) requires the common areas of apartment properties to be smoke-free. Smoking is prohibited inside and within 20 feet of entrances, open windows, and ventilation systems of enclosed common areas of multi-family housing such as the main office, laundry room, fitness center, activity center, or clubhouse. Contact the Smoke-Free Arizona Office at 1-877-AZ-STOPS or visit http://www.smokefreearizona.org/submit-complaint.asp to submit a complaint or report a violation.

You may wish to look up the information at the above website regarding both tenants and landlords rights in regards to smoking.
