Question: can my landlord/property manager enter my gated back yard without proper notice. i have small children who play out in the backyard and feel that we should have our privacy when in our home but he just comes over when ever he feels like it. he does not enter the house just the yard in the lease it says that we as the tenants are responsible for maintenance in the front and back yard so there is really no reason for him to be there, he also sprays weed poison with out telling us is any of this legal.
Answer: A.R.S. § 33-1343 describes when a landlord may access a tenants residence. A.R.S. § 33-1343: A tenant cannot unreasonably withhold consent to the landlord to enter the residence in order to inspect the premises or make repairs. Unless there is an emergency or unless it is impracticable to do so, the landlord must give the tenant at least two days notice that he is going to enter the residence. The landlord can only enter at reasonable times. You may want to hire a licensed attorney in order to get more specific information regarding your issue.
