Question: 2 questions: 1. tenant have right to security deposit if they break lease unjustifiably 5 months early? 2. Walkthru honored for the same?
Answer: The security deposit is for the purpose of protecting you from financial loss due to the tenants violation of the lease. Once a tenancy is terminated you must return the deposit unless you have suffered economic damage as a result of the tenants actions (for example unpaid rent or damage to the unit). You must calculate the amount of your loss and then you can deduct it from the deposit. You should send a letter to the tenant telling them what you have done and why you have done it. I do not understand the second question.
