Question: Someone staying with me, paying rent, I need to evict due to conflict. What do I have to do to evict?
Answer: When a tenant is residing in dwelling under the terms of a verbal (or written) rental agreement and paying rent every month, the Arizona Residential Landlord and Tenant Act requires the landlord to provide the tenant with 30 days’ advance written notice of the landlord’s intention to terminate the rental agreement (A.R.S. 33-1375). This is how the landlord may “terminate” the rental agreement. Only if the tenant has violated the rental agreement in some significant way may the landlord notify the tenant in writing that if the tenant does not fix/stop the violation within ten days (or 5 days if the violation presents a threat to health or safety) then the landlord will file an eviction complaint against the tenant in court and ask a judge to “evict” the tenant (A.R.S. 33-1361(A)).
