Question: Can a landlord lawfully send you a 30 day notice to vacate in a form of a text message instead of a written notice as called for in the lease agreement? is this legal?
Answer: The Arizona Residential Landlord and Tenant Act states only that “the landlord or the tenant may terminate a month-to-month tenancy by a written notice given to the other at least thirty days prior to the periodic rental date specified in the notice” (A.R.S. 33-1375). It does not specify what constitutes a “written” notice even though, traditionally, the landlord was expected to deliver a piece of paper to the tenant.
